The Small Print > Acceptable Use Policy

Introduction

It is the responsibility of all customers of magdesign's services to ensure that they comply with the latest edition of the AUP at any given time. This Acceptable Use Policy may be revised, without notice, at any time, at the sole discretion of magdesign. Connection to any of magdesign's services, is deemed to be an agreement to our Terms and Conditions and this Acceptable Use Policy. In the event of a breach of this policy, magdesign reserve the right to terminate all or part of any service with immediate effect, without recompense, and delete any files held on our servers

Compliance with UK Law

Customers must not publish, link, or display unlawful material (as defined by UK law and publication regulations or as defined by the laws and regulations of the Customer's location, situated or resident) and any other material that are pornographic, malicious, abusive, or which encourage acts of violence or terrorism, slander, defamation, or which are in breach of magdesign's or any Third Party's Intellectual Property Rights, or which aid the distribution of Computer Viruses or warez.

Irresponsible Usage

It is the responsibility of all customers of magdesign's services to ensure that their account is not used in an irresponsible manner. This may include, but is not limited to, sending unsolicited (spam), offensive, indecent or abusive emails and/or emails for the purpose of committing fraud, phishing or a criminal offence. In the event that a customer's service is used in a manner that magdesign considers irresponsible, magdesign reserve the right to terminate all or part of the service with immediate effect. Wherever possible, magdesign will notify the customer of the termination in advance.

Email

Customers must not use magdesign's email services to send unsolicited (spam), offensive, indecent or abusive emails and/or emails for the purpose of committing fraud, phishing or a criminal offence. magdesign reserve the right to remove any mail of this nature from its servers and terminate all or part of the service with immediate effect. Wherever possible, magdesign will notify the customer of the termination in advance.

Whilst the sending of mail lists and newsletters is permitted, customers must provide to magdesign, on request, proof that the subscriber/s did opt-in to the mailing list and that a facility is available for subscriber/s to opt-out.

magdesign currently operates a maximum mailbox size policy of 10mb on its shared hosting plans. In the event that a customer's mailbox reaches this limit, they will be unable to receive email until the size is reduced. To prevent this from happening, magdesign recommends customers do not select any option in their mail client/s to save messages on the server.

Hosting

Customers are responsible for the content of their website and webspace. This includes, but is not limited to, ensuring that they have the legal permission for any pages they publish and that the content of these pages does not violate UK law. magdesign reserve the right to remove any content that does not comply with our Terms and Conditions or Acceptable Use Policy without notice, explanation or recompense.

Customers will be held solely responsible for any defamatory, confidential, secret or other proprietary material made available via their website.

Customers are responsible for ensuring their login details are kept safe and not disclosed to third parties except in the case that the third party is working on the customer's behalf. It is recommended that customers change their generated password as soon as possible and that the new password is made available to the magdesign Support either by telephone or support ticket to assist with any future support queries the customer may have.

Customers are responsible ensuring their data is suitably backed up. Whilst magdesign may keep backups of its servers, these are for disaster recovery only and cannot be used to restore customer's data. magdesign cannot be held liable for any loss of data, information or loss of business or earnings from the loss, damage or failure of any hardware or other equipment including that of third parties.

Customers are responsible for ensuring that excessive use of any features described as unlimited does not adversely affect the performance of any of magdesign's services. In the event that the performance of any of magdesign's service is affected by any of its customer's, magdesign will contact the customer and may, in extreme circumstances, terminate all or part of the customer's services.

magdesign reserves the right to remove any Free Hosting account that has not been used or accessed for a period of 30 days or more.

On closure of the customer's account, all website data will be removed from magdesign's servers within 30 days of termination.
